1 Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Tutors Hub Namibia website, mobile application, and services (collectively, the "Platform"), operated by Tutors Hub Namibia ("Company", "we", "us").

By registering for an account, clicking "Get Started", or otherwise accessing the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

2 Description of Service

Tutors Hub Namibia is a free online marketplace that facilitates connections between students seeking educational assistance and independent tutors offering their services. The Platform allows tutors to create profiles, and students to discover tutors and request booking sessions.

3 Eligibility and Account Registration

• You must be at least 13 years of age to use this Platform. Users aged 13–17 require parental or guardian consent.
• You must provide accurate, complete, and current information when registering.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You may not create more than one personal account. You may not create an account on behalf of another person without their explicit consent.
• You must notify us immediately at support@tutorshub.na if you suspect unauthorised use of your account.
• We reserve the right to suspend or terminate any account that violates these Terms, without prior notice.

4 User Conduct

You agree NOT to use the Platform to:

• Post false, misleading, or fraudulent content, including fake qualifications or fake reviews.
• Harass, abuse, threaten, defame, or discriminate against any other user.
• Engage in any form of academic dishonesty, including completing assessments on behalf of students.
• Solicit payment outside the platform in a manner intended to evade our systems or other users.
• Impersonate any person, organisation, or entity.
• Upload or transmit viruses, malware, or any harmful code.
• Scrape, crawl, or otherwise extract data from the Platform without our written permission.
• Use the Platform for any illegal purpose under Namibian law or international law.
• Attempt to gain unauthorised access to any part of the Platform or its infrastructure.

Violation of these rules may result in immediate account suspension, permanent banning, and where applicable, reporting to relevant authorities.

5 Booking and Payments

• Booking requests submitted through the Platform are requests only — they must be approved by the tutor before a session is confirmed.
• All payment arrangements are made directly between the student and the tutor. Tutors Hub Namibia does not process, hold, or guarantee any payments.
• Tutors set their own hourly rates and the Platform displays an estimated cost for informational purposes only.
• Any payment disputes are solely between the student and the tutor. The Platform is not a party to any financial transaction.
• Students and tutors are encouraged to agree on payment terms before a session takes place.
• Tutors are responsible for their own tax obligations arising from income earned through tutoring services arranged via the Platform.

6 Reviews and Ratings

• Reviews must be honest, fair, and based on your actual experience with the tutor or student.
• You may not post reviews containing personal attacks, hate speech, or defamatory content.
• We reserve the right to remove reviews that violate these Terms or our Acceptable Use Policy.
• Tutors may not solicit fake reviews or offer incentives in exchange for positive reviews.
• We may use review data to calculate ranking scores displayed on the Platform.

7 Intellectual Property

• The Tutors Hub Namibia name, logo, design, and all Platform content created by us are our intellectual property and may not be copied or used without written permission.
• Content you create on the Platform (profile descriptions, reviews) remains yours. By posting it, you grant us a non-exclusive, royalty-free, worldwide licence to display it on the Platform.
• You confirm that any content you submit does not infringe on the intellectual property rights of any third party.

10 Indemnification

You agree to indemnify, defend, and hold harmless Tutors Hub Namibia, its operators, directors, and staff from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to the Platform.

11 Termination

• You may delete your account at any time by contacting us at support@tutorshub.na.
• We reserve the right to suspend or terminate your account at any time, with or without cause and with or without notice, particularly for violations of these Terms.
• Upon termination, your right to use the Platform ceases immediately. Sections regarding Limitation of Liability, Indemnification, and Governing Law survive termination.

12 Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Republic of Namibia. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Namibia. We encourage users to first attempt resolution through our support channel at support@tutorshub.na.

13 Changes to These Terms

We reserve the right to modify these Terms at any time. Changes take effect when posted on this page. For significant changes, we will notify registered users via a platform notification. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
