Tutor Agreement

Last updated: January 1, 2025

This agreement applies to all tutors registered on Tutors Hub Namibia. By registering as a tutor and submitting a profile, you confirm that you have read, understood, and agree to these terms in addition to our general Terms of Service.

1 Independent Contractor Status

You are an independent contractor — not an employee of Tutors Hub Namibia.

  • Nothing in this Agreement creates any employer-employee relationship, partnership, joint venture, agency, or franchise between you and Tutors Hub Namibia.
  • You set your own hours, rates, teaching methods, and session locations.
  • You are solely responsible for all equipment, materials, and resources needed to deliver your tutoring services.
  • You are not entitled to any employee benefits, including health insurance, pension, or annual leave from Tutors Hub Namibia.
  • You are solely responsible for your own tax obligations, including income tax and VAT (where applicable) on fees earned through tutoring services. Tutors Hub Namibia does not withhold any taxes on your behalf.

2 Eligibility to Tutor

To register and remain active as a tutor, you confirm that you:

  • Are at least 16 years of age (if under 18, you require parental consent).
  • Possess genuine knowledge, skills, or qualifications in the subjects you list.
  • Are legally permitted to work or provide services in Namibia.
  • Are not subject to any court order, criminal conviction, or professional disciplinary action that would make it inappropriate for you to work with students.
  • Will promptly update your profile if any of the above circumstances change.

3 Profile Accuracy and Honesty

  • All information you provide on your profile must be truthful and accurate, including your name, photo, qualifications, subjects, and rate.
  • You must not misrepresent your qualifications, experience, or identity.
  • Profile photos must be a genuine likeness of yourself — no logos, stock images, or images of other people.
  • You must not list subjects you are not competent to teach.
  • Any claims of university affiliation, degrees, or certifications must be genuine and verifiable.
  • Misrepresentation constitutes grounds for immediate and permanent removal from the Platform.

4 Professional Standards and Conduct

You agree to maintain a high standard of professionalism in all your interactions with students:

  • Respond promptly: Respond to booking requests within a reasonable time (ideally within 24 hours).
  • Honour commitments: Once a booking is approved, honour it. Cancellations must be communicated to the student as early as possible.
  • Punctuality: Arrive or connect on time for all sessions.
  • Safe environment: Ensure all in-person sessions take place in appropriate, safe, and professional settings.
  • No exploitation: You must not exploit, manipulate, or take advantage of any student, particularly minors.
  • Appropriate boundaries: Maintain appropriate professional boundaries with all students at all times.
  • Non-discrimination: You must not discriminate against students based on race, gender, religion, disability, or any other protected characteristic.

5 Academic Integrity

Zero Tolerance for Academic Dishonesty

Tutors Hub Namibia strictly prohibits any form of academic dishonesty.

You must not:

  • Complete assignments, tests, or examinations on behalf of students.
  • Write academic work (essays, reports, theses) to be submitted as the student's own work.
  • Assist students in cheating during any form of assessment.
  • Offer or advertise "exam completion", "assignment writing", or similar services through the Platform.

Violation of this clause will result in immediate permanent banning from the Platform and, where applicable, reporting to academic institutions and authorities.

6 Safeguarding of Minors

If you tutor students who are under 18 years of age, you agree to:

  • Obtain parental or guardian consent before providing tutoring services to minors.
  • Conduct in-person sessions with minors only in open, appropriate, and visible locations — never in private settings without another adult present.
  • Never communicate with minors through personal, private channels outside of what is necessary for tutoring sessions.
  • Immediately report any safeguarding concerns to the relevant authorities and notify us at safety@tutorshub.na.
  • Comply with all applicable Namibian child protection laws and regulations.

7 Rates and Payments

  • You set your own hourly rate, displayed on your public profile.
  • All payment transactions are arranged directly between you and the student. Tutors Hub Namibia does not process payments, take commissions, or guarantee payment.
  • You are responsible for pursuing any unpaid fees through your own means. The Platform accepts no liability for non-payment by students.
  • You must charge the rate displayed on your profile at the time of the booking. Changing rates mid-session or charging undisclosed fees is not permitted.
  • You are responsible for issuing receipts or invoices to students if required.

8 Platform Approval and Removal

  • All new tutor profiles are subject to admin review and approval before being publicly listed.
  • We reserve the right to reject, suspend, or remove any tutor profile at our sole discretion, including for reasons of safety, quality, or policy violations.
  • We may remove tutors who maintain consistently low ratings or receive repeated complaints from students.
  • We may introduce verification programmes in future and require tutors to submit supporting documents.

9 Tutor Liability

  • You are solely responsible for the tutoring services you provide.
  • Tutors Hub Namibia shall not be held liable for any harm, loss, or damage (physical, financial, academic, or otherwise) arising from your tutoring services.
  • You agree to indemnify Tutors Hub Namibia against any claims made against us as a result of your actions or omissions as a tutor.
  • It is your responsibility to ensure you have adequate insurance if required for in-person services.

By Registering as a Tutor, You Confirm:

  • I have read and agree to the Tutor Agreement, Terms of Service, and Privacy Policy.
  • All information on my profile is truthful and accurate.
  • I am an independent contractor and not an employee of Tutors Hub Namibia.
  • I will maintain professional standards in all student interactions.
  • I will never complete academic work on behalf of students.
  • I will comply with all Namibian laws applicable to my tutoring activities.
  • I am solely responsible for my own tax obligations.
